Legal framework

Compulsory motor insurance in Spain is governed by Real Decreto Legislativo 8/2004 (Texto Refundido LRCSCVM) and its implementing regulations. Every motor vehicle that circulates on Spanish roads must hold valid third-party liability cover (Seguro Obligatorio del Automóvil — SOA). Driving without insurance — or keeping an uninsured vehicle parked on a public road — is sanctioned with fines of €601 to €3,005, plus immobilisation or deposit of the vehicle.

Compulsory minimum cover amounts

Spanish motor cover has two third-party liability layers. RC Obligatoria (compulsory liability) is set by law and EU Directive 2009/103/EC at up to €70 million for personal injury and €15 million for property damage per accident (in force since 2008 and maintained, not raised, by Ley 5/2025). On top of this, RC Voluntaria (voluntary liability) is an optional extension offered by insurers that typically adds a further €40–€50 million of cover. Required documents to insure

To insure a Spanish-plated vehicle, your insurer needs:

  • Permiso de Circulación — the registration document
  • Ficha Técnica — the technical specifications
  • A current ITV certificate (the MOT equivalent — every two years up to 10 years old, then yearly)
  • The driver's NIE or DNI
  • A Spanish driving licence, or a UK licence within the post-Brexit exchange window (currently extended to 31 December 2026)

Claim deadlines and Declaración Amistosa

Claims must be reported to your insurer within seven days under Ley 50/1980 Article 16. At the scene of an accident, drivers complete the Declaración Amistosa de Accidente (DAA) — the European Accident Statement form — signed by both drivers. If the other driver refuses to sign, call the Guardia Civil (091 / 062). Hit-and-run, uninsured-driver and stolen-car claims are paid by the Consorcio de Compensación de Seguros when the at-fault driver cannot be identified.

Total loss and depreciation

When repair costs go above the market value of the car (or a set percentage, often 75%), the insurer declares a siniestro total. It then pays the market value rather than the repair cost. Some todo riesgo policies include a valor de nuevo (new-for-old) clause for the first 2 years after first registration. This pays the original purchase price instead of the depreciated value. Standard exclusions

Common motor exclusions are:

  • Driving under the influence of alcohol or drugs (blood alcohol limit 0.5g/l, 0.3g/l for new drivers)
  • Driving without a valid licence
  • Using the vehicle for racing, rallies or paid carriage of goods or passengers when not declared
  • Gross negligence

Leaving the vehicle unattended with the keys in the ignition voids theft cover. Damage from extraordinary risks (flooding, severe atypical storms, earthquake, terrorism or riots) is covered by the Consorcio de Compensación de Seguros on any vehicle with a valid Spanish motor policy.

Cancellation rights

Annual contracts auto-renew under Ley 50/1980 Article 22. Cancellation requires at least one month's written notice before renewal. Mid-year cancellation is allowed if you sell the car (with proof — contrato de compraventa or baja registration) or change to a different vehicle, in which case any unearned premium is refunded.

It's the Spanish equivalent of UK no-claims discount. Each year of claim-free driving moves you down a level (lower premium); each at-fault claim moves you up several levels (higher premium). The Consorcio de Compensación de Seguros is a Spanish state-backed body funded by levies on every insurance policy. It pays for damage caused by extraordinary natural events (severe floods, earthquakes, atypical storms, terrorism), and pays victims of uninsured drivers and hit-and-run accidents. If your car is damaged in a Consorcio event your insurer routes the claim through them. Spanish insurance customers do not pay anything extra for Consorcio cover — it is automatically included.
Yes. We can issue cover on the VIN (chassis number) immediately on the day of purchase — before the change of ownership at Tráfico is registered. This is essential because under Spanish law it is illegal to drive away from a private sale uninsured, and the seller's policy cannot be relied on — the law can transfer it with the car, but insurers routinely cancel or re-quote once notified of the sale. In practice we issue cover the same morning as a private sale, so you can drive away legally insured.
Sat-navs, mobile phones, wallets and personal items left visible in the car are NOT typically covered under Spanish comprehensive (todo riesgo) policies — even if the car is broken into. Items locked in the boot may be covered up to a small limit (often €300–€600) on some policies. Permanently fitted equipment (factory radio, integrated nav) is normally covered. Always remove valuables from the car when parking, particularly in tourist areas of the Costa Blanca.
The 'Permiso de Circulación' (registration document), 'Ficha Técnica' (technical specifications card), current ITV (MOT-equivalent) certificate, your DNI/NIE and driving licence, plus proof of no-claims bonus or the name of your previous insurer if already in the Spanish system. For an imported car, we work from the V5C and chassis number to set the cover up, then issue the policy on your Spanish temporary import ('P') plate once Tráfico assigns it during matriculación.
Yes. Spanish car policies have a 'tomador' (policyholder), 'asegurado' (insured) and 'conductor habitual' (main driver), plus you can add named additional drivers. Family members (spouse, partner, children) usually no extra cost. Adding young or inexperienced drivers (under 25, or with under 2 years' licence) can attract a premium loading or an excess uplift on claims. Be honest about who actually drives — fronting (claiming a low-risk parent is the main driver when it's actually a teenager) voids cover.

No — you can insure a car before it has a Spanish ITV (roadworthiness inspection). However, if you are importing a foreign vehicle and need to go through the Spanish matriculación process, you will need both insurance and an ITV to complete the registration. Once registered in Spain, ITV is required every 4 years for vehicles under 10 years old, then every 2 years. If your ITV lapses, your insurance policy technically remains valid (the insurer will still pay third-party claims) but you may face traffic fines and complications if involved in an accident. Always keep your ITV current.

Car insurance in Spain works similarly to the UK but with some important differences. The three cover levels are terceros (third party civil liability — mandatory minimum), terceros ampliado (third party plus fire, theft, glass and breakdown), and todo riesgo (fully comprehensive). Key differences from the UK: Spain uses a bonus-malus system that rewards claim-free driving with progressive discounts and penalises claims with premium increases. The insured vehicle is covered under the policy regardless of who drives it (unlike some UK policies which restrict to named drivers only). Annual mileage is less of a pricing factor than in the UK. Yes — but the answer depends on which of two situations you are in. Visiting temporarily (up to 90 days): your UK policy already provides at least third-party cover throughout the EU and EEA automatically, and no Green Card has been required for Spain since August 2021. Check your UK policy for the European extension if you want comprehensive rather than the third-party minimum. Living here: once you are resident, the UK-registered car must be re-registered in Spain (matriculación) within 30 days. When you hire a car in Spain, the rental company is legally required to provide minimum terceros (third party liability) cover, and this is included in the rental price. Most also include a Collision Damage Waiver (CDW) — but CDW normally carries a substantial excess of €500–€3,000 on damage to the vehicle itself, which you remain liable for. Excess protection (also called car hire excess or waiver insurance) removes or reduces that.
